This may be a dumb question but does one really need to ask for posting permission when regarding manips?

I gave it some thought over the course of the day after reading this comment, trying to sort out legalities and whatnot.

Way I figure it, the answer is...split.

A manip is simply an edit of an original work. I could be wrong about this, but from what I understand, the manip in this case would still be considered the work of the original artist, or at best (I figure, in some extremely edited manips), a derivative work.

As far as I understand, in these cases, the US law is not clear on how it would be properly handled - it just wasn't written with that in mind. It would probably be up to a judge, if any such issue was ever brought to a court.

However, in the cases where the manip is paired with text, such as this one, and the text is original on part of the manipper, then that text is an original work by the author (the manipper), whether it's attached to another's work or not. In such a case, the law is relatively clear that the manipper would have the rights over the text on the manip, as it is his/her original work.

All in all, I figure we'll (we as in the booru) treat manips similarly to that of original artwork in cases of copyright. They'll be posted here, permission or not, because expecting us to get permission to repost something from the internet on a booru is a tad absurd. However, if the artist/author/manipper/whatever has a problem with having their work on this site, than they just need tell us and we'll remove.

Would it make you feel any better, L+N, if I told you that this site is hosted in a country that doesn't have to adhere to U.S. copyright laws? The booru.org administration do it out of good faith, not due to legalities (or so they said in response to a legal action threat on their forums).

So, the chances of us being taken down by DMCAs is slim at best, until we end up wearing the patience of the our gracious booru.org administration.
